Terms of Service

Please read these terms carefully before using Employ Uganda. By using our platform, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using Employ Uganda (the "Platform"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, please do not use our Platform. These Terms constitute a legally binding agreement between you and Employ Uganda.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Platform following any changes constitutes your acceptance of the revised Terms. Please review these Terms periodically for updates.

Important: These Terms apply to all users of the Platform, including job seekers, employers, recruiters, and visitors. By using our Platform, you acknowledge that you have read, understood, and agree to these Terms.

2. Eligibility

By using the Platform, you represent and warrant that:

  • You are at least 16 years of age (or the age of majority in your jurisdiction)
  • You have the legal capacity to enter into a binding agreement
  • You are not prohibited from using the Platform by applicable law
  • You will provide accurate and complete information when registering
  • You will maintain the confidentiality of your account credentials

3. User Accounts

3.1 Account Registration

To access certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Update your information promptly to maintain accuracy and completeness
  • Use a valid email address that you regularly access
  • Not share your account credentials with others
  • Notify us immediately of any unauthorized use of your account

3.2 Account Security

You are responsible for maintaining the security of your account and password. We are not liable for any loss or damage arising from your failure to comply with this security obligation. You may not use another user's account without their explicit permission.

3.3 Account Types

  • Job Seeker Accounts: For individuals seeking employment opportunities
  • Employer Accounts: For companies and organizations posting job vacancies
  • Recruiter Accounts: For recruitment agencies and headhunters

4. Job Seeker Terms

4.1 Application Process

As a job seeker, you may:

  • Create and maintain a profile with your qualifications and experience
  • Apply to job postings that match your skills and interests
  • Receive notifications about new job opportunities
  • Communicate with employers through our platform

4.2 Accuracy of Information

You are responsible for the accuracy and completeness of all information you provide, including your resume, work history, education, and contact details. Misrepresentation or falsification of information may result in the termination of your account.

4.3 Application Responsibility

You understand that:

  • Submitting an application does not guarantee employment
  • Employers are responsible for their hiring decisions
  • We are not involved in the employer-job seeker relationship
  • We do not guarantee the authenticity or accuracy of job postings

5. Employer Terms

5.1 Job Postings

As an employer, you agree to:

  • Provide accurate and truthful information about job opportunities
  • Specify compensation, benefits, and requirements clearly
  • Respond to job applications in a timely manner
  • Comply with all applicable labor laws and regulations
  • Not post fraudulent or misleading job listings

5.2 Employer Responsibility

You are solely responsible for:

  • All content you post, including job descriptions and company information
  • Your interactions with job seekers
  • Complying with employment laws and equal opportunity regulations
  • Protecting confidential information shared by job seekers

5.3 Premium Services

We may offer premium services for employers, including featured job postings and enhanced visibility. Payment for these services is subject to our payment terms and conditions. All fees are non-refundable unless otherwise stated.

Important Notice: Employers must not request payment from job seekers for any reason, including application fees, training costs, or visa processing. Any such activity is strictly prohibited and will result in immediate account termination.

6. User Content

6.1 Ownership

You retain ownership of all content you post on the Platform. However, by posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and improving the Platform.

6.2 Content Guidelines

All user content must comply with our content guidelines. You may not post content that is:

  • Offensive, discriminatory, or harassing
  • Fraudulent, misleading, or deceptive
  • Copyrighted or protected by intellectual property rights (without permission)
  • Contains viruses, malware, or harmful code
  • Violates any applicable laws or regulations

6.3 Content Monitoring

We reserve the right to review, monitor, and remove any user content that violates these Terms or is otherwise objectionable. We are not responsible for the accuracy or reliability of user-generated content.

7. Prohibited Activities

You agree not to engage in any of the following activities:

  • Using the Platform for any unlawful purpose
  • Posting false, inaccurate, or misleading information
  • Scraping, data mining, or using automated tools without authorization
  • Attempting to gain unauthorized access to other accounts or systems
  • Interfering with the operation of the Platform
  • Harassing, threatening, or abusing other users
  • Impersonating any person or entity
  • Posting content that violates third-party rights
  • Engaging in fraudulent or deceptive practices
  • Circumventing security measures or access controls

8. Intellectual Property

All content on the Platform, including text, graphics, logos, icons, images, software, and code, is the property of Employ Uganda or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Reproduce, modify, or distribute our content without permission
  • Use our trademarks or logos without prior written consent
  • Reverse engineer or decompile any software on the Platform

9. Third-Party Links

Our Platform may contain links to third-party websites, applications, or services that are not owned or controlled by us. We are not responsible for the content, privacy practices, or terms of service of any third-party sites. Your use of third-party sites is at your own risk.

10. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without any warranties of any kind, whether express or implied. We do not guarantee that:

  • The Platform will be uninterrupted, timely, or error-free
  • Job postings are accurate, complete, or current
  • Employers will respond to applications
  • The Platform is free of viruses or harmful code
  • Your use of the Platform will result in employment

We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

Important: We do not guarantee the authenticity or accuracy of any job posting, resume, or user information. We recommend that you exercise caution and verify the legitimacy of any opportunity before providing personal information or payment.

11. Limitation of Liability

To the maximum extent permitted by law, Employ Uganda and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or reputation
  • Damages arising from employment decisions
  • Damages from interactions with employers or job seekers

In no event shall our total liability exceed the total fees paid by you, if any, for using the Platform during the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold Employ Uganda harmless from any claims, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content posted on the Platform
  • Any dispute between you and other users

13. Termination

We reserve the right to terminate or suspend your account and access to the Platform at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Engaging in prohibited activities
  • Providing false or misleading information
  • Extended periods of inactivity
  • At our sole discretion

Upon termination, your right to use the Platform will cease immediately. We may delete your account and associated content at our discretion.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Uganda, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Uganda.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Effective Date" at the top of this page
  • Sending a notification to your registered email address (if applicable)

Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
